Internships : Changes for September 2015

"Tired of being a cash cow? "
As Future interns, you might be wondering what the Law provides for you. Please note that from September 2015, new rules will be applied on companies in order to improve an intern's status.

In fact, June 26th act, 2014 is intended to prevent abuse of trainees in the workplace. Therefore, 7 major changes will take place from autumn 2015.

Theses changes are listed below:

1) The end of over 6 months trainings
The maximal duration of a training will not have to overtake 6 consecutive months in the same company.

2) The limitation of working hours
The time that the trainee spends in the company, set by the training agreements, can not exceed the term of working hours of employees of the host company. In other words, this amounts, in most cases, from 35 hours up to 39 hours per week.

3) A fee on the first day of the internship if it's for more than two months

For all training courses over two months, the compensation becomes mandatory from day 1. However, courses not exceeding two months may not be paid.

4) The ability to take off days
The training agreement must provide "the opportunity to leave the workplace if it is necessary.” Indeed, you will benefit from leave, equivalent to those provided for employees only for pregnancy duration, paternity or adoption.

5) A higher and non-taxable wage
By 2015, the "minimum bonus" of a trainee will increase from  436 euros to 523 euros.  (+87 euros) In addition, Article 81 of the General Tax Code exempts training allowances within the limits of the annual amount of the minimum wage.

6) Work Safely
The intern will not be assigned  “dangerous” missions as part of his/her training. Indeed, "It is forbidden to employ the trainee on dangerous tasks for his/her safety. "

7) Support for catering and transport

This is the most important right for interns! You can get meal vouchers without having to pay  back for it, and partial financial support for your transport costs will be granted, if they are of any use for employees.

My analysis 

All these measures to improve the working conditions of students are a step in the protection of their rights.

But they also are an obstacle to get the internship because of the introduction of quotas (limiting the number of students based on the number of the company) and higher salaries. Companies, especially SMEs will find it harder to hire interns because of their weakened financial situation.

Moreover, it is important to remember that the training provides not only many experiences for the future but it also provides knowledge and skills. And this is the motivation for trainees. Nevertheless, it is true that a good training is allowed by the respect of the working conditions.
